LAW

Disability Groups Urge Confirmation of Sotomayor Based on Extensive Disability Rights Record
(Bazelon Center For Mental Health Law)
July 16, 2009

WASHINGTON, DC– [Excerpt] A coalition of national disability advocacy organizations today announced support for the confirmation of Judge Sonia Sotomayor as an Associate Justice of the United States Supreme Court based on her extensive experience in, and careful approach to, deciding disability rights cases.

“Judge Sotomayor has repeatedly demonstrated a thorough understanding and a deep respect for the laws that protect the rights of Americans with physical and mental disabilities, like the Americans with Disabilities Act and the Individuals with Disabilities Education Act. We have every reason to believe she will continue this stellar record when confirmed to the Supreme Court,” said Robert Bernstein, Ph.D., executive director of the Bazelon Center for Mental Health Law.

In a letter of support sent to members of the Senate Judiciary Committee on Tuesday, national disability organizations cited Judge Sotomayor’s meticulous consideration of the facts and the law in deciding whether plaintiffs are protected by disability rights laws, and in deciding whether such individuals have suffered discrimination. The letter also cites Judge Sotomayor’s life experience as a person with insulin-treated diabetes as a reason to believe that she will fairly protect the rights of all Americans, including people with disabilities.

EDUCATION

Supreme Court Rules Parents Can Seek Public Funds For Private Schools
(New York Times)
June 22, 2008

WASHINGTON, DC– [Excerpt] In a decision that could help disabled students obtain needed services and cost school districts millions of dollars, the Supreme Court ruled on Monday that parents of special-education students may seek government reimbursement for private school tuition, even if they have never received special-education services in public school.

The case before the court involved a struggling Oregon high school student, identified in court documents only as T. A., whose parents removed him from public school in the Forest Grove district in his junior year and enrolled him in a $5,200-a-month residential school.

Although Forest Grove officials had noticed T. A.’s difficulties and evaluated him for learning disabilities, he was found ineligible for special-education services. Only after he enrolled in the private school did doctors say T. A. had attention deficit hyperactivity disorder and other disabilities.

While most of the nation’s six million special-education students attend public school, as T. A. did for many years, thousands of families with disabled children, convinced that the public schools lack appropriate placements, avoid the public schools altogether. Instead, they enroll their children in expensive private schools for students with emotional or learning disabilities, and then seek reimbursement.

COMMUNITY LIVING

White House Launches “Year Of Community Living” On Olmstead Anniversary
(The White House Press Office)
June 23, 2009

WASHINGTON, DC– [Excerpt] On the 10th anniversary of the landmark Supreme Court decision in the case of Olmstead v. L.C., President Barack Obama today celebrated that anniversary and launched “The Year of Community Living,” a new effort to assist Americans with disabilities.

Specifically, the President has directed Health and Human Services Secretary Kathleen Sebelius and Housing and Urban Development Secretary Shaun Donovan to work together to identify ways to improve access to housing, community supports, and independent living arrangements.

As part of this effort, later today, Secretaries Sebelius and Donovan will announce several new initiatives including details about increased numbers of Section 8 vouchers and enhanced interagency coordination to address this critical civil rights issue. The initiative also will include listening sessions conducted by HHS across the country to hear the voices and stories of Americans and to keep the President’s pledge to be as open and transparent as possible.

“The Olmstead ruling was a critical step forward for our nation, articulating one of the most fundamental rights of Americans with disabilities: Having the choice to live independently,” said President Obama. “I am proud to launch this initiative to reaffirm my Administration’s commitment to vigorous enforcement of civil rights for Americans with disabilities and to ensuring the fullest inclusion of all people in the life of our nation.”

TECHNOLOGY

Let Your Tongue Do The Driving
(New Scientist)
July 6, 2009

ATLANTA, GEORGIA– [Excerpt] A headset that makes it possible for a person to precisely control a wheelchair or computer using only their tongue has begun trials with spinal injury patients in the US.

The “tongue drive” could also give astronauts a third hand in difficult situations such as space walks.

The device works by using two sensors to track a 5-millimetre-wide magnet attached to the tip of the user’s tongue.

The sensors – embedded in a wireless headset – read the fluctuations in the strength of the magnetic field as the tongue moves and transmit the signals on to a computer, where they are interpreted and acted upon.

By moving the tongue in predefined patterns, the user can steer a cursor on a screen, direct a wheelchair, or switch on a TV, for example.

EMPLOYMENT / LAWS

EEOC Getting More Aggressive In Pursuing Disability Claims
(The National Law Journal)
July 1, 2009

NEW YORK, NEW YORK– [Excerpt] Disability discrimination complaints are on the rise in the workplace, with several employers getting hit with disability bias lawsuits in recent months.

In back-to-back filings last week, the Equal Employment Opportunity Commission filed disability bias lawsuits against retail giant Kmart Corp. and a Chicago-area beverage company, which was sued Thursday in federal court in the Northern District of Illinois.

The EEOC say these cases highlight a growing trend in the workplace, noting that disability bias complaints rose to 19,453 in 2008 — a 10 percent increase from the year before, and the highest level in 14 years.

“It is unfortunate that many employers still deny people who are ready and able the opportunity to work simply because of a disability. The EEOC will continue to fight for the rights of people victimized by such prejudices,” said Herbert Brown, director of the EEOC’s Norfolk, Va., office.

Hidden in Plain Sight: Looking for Mental Illness

With their mental health histories kept secret, ten adults enter a period of psychiatric observation in an isolated group setting. It is up to a panel of experts to determine who is healthy and who isn’t.

This program documents the first three days of the session, which features several tests designed to bring out evidence of mental disorders. Simulated urban warfare evokes reckless behavior; stand-up comedy stints highlight social anxiety; a barn-cleaning task points to aspects of OCD; and the Wisconsin Card Sort Test brings flexibility, or a lack thereof, into focus.

By the end of the program, the assembled mental health professionals are only beginning to distinguish between illness and eccentricity. A BBC/Science Channel Co-production.

Clinical Impressions: Identifying Mental Illness

How long can mental illness stay hidden, especially from the eyes of trained experts? This program rejoins a group of ten adults—five of them healthy and five of them with histories of mental illness—as psychiatric specialists try to spot and correctly diagnose the latter.

Administering a series of collaborative and one-on-one tests, including assessments of personality type, physical self-image, and rational thinking, the panel gradually makes decisions about who suffers from depression, bipolar disorder, bulimia, and social anxiety. At the conclusion of the program, the professionals confess to a wariness of their own diagnosis methods, and labels of “sick” and “normal” are seen in a new light. Today’s students face an enormous range of emotional issues—worries about academic performance, anxiety about how peers view them, problems with parents and teachers, concern over physical appearance, and much more.

Using a combination of real kids talking about their problems, two teen hosts plus an adolescent psychologist, the program explores coping with anxiety, dealing with anger and rage, and experiencing sadness or depression.

A psychologist presents common problems and points out the differences between “normal” reactions to stressors and situations, and when it might be necessary to get help. Video also covers the basics of good mental health, emphasizing what to do when ordinary anxiety deepens, or when worries become too overwhelming to handle without intervention. Teacher’s Resource Book includes worksheets and activities to further explore this crucial topic.

Educational recovery goals are to stimulate the economy in the short-term and invest wisely; using The American Recovery and Reinvestment Act (ARRA) stimulus funds to improve schools, raise achievement, drive reforms and produce better results for children and young people. A significant portion of the educational plan is dedicated to grants to help close long-standing achievement gaps and ensure better educational, employment and independent living outcome for children and adults with disabilities.

By providing innovative resources that promote inclusion, facilitate learning and educate about disabilities, Program Development Associates (PDA) http://www.disabilitytraining.com has supported these goals for over twenty-five years. We are here today with the same intent. With the depth our collection, PDA is in a position to help your school or agency meet many of the objectives of ARRA.

From our collection of over 600 disability resources, we have sorted and selected DVDs, curriculum and multi media resources on topics related to stimulus plans in IDEA, Title I, Independent Living and Vocational Rehabilitation funding.

If you follow the link to PDA’s ARRA Resource Center http://www.disabilitytraining.com/arra-main.php, you will find:

• Professional Development and School Wide Strategies to improve teacher quality and improve outcomes for students with disabilities

• Innovative resources that will scale-up reading and math, enhance Response to Intervention, and Positive Behavioral Approaches.

• Transition and Employment tools to help coordinate community job placements and improve services to individuals with significant disabilities

• Pre-School and Assistive Technology methods that help young children succeed and help close the achievement gap and improve outcomes

• Independent Living Practices that can help service providers increase the number of people with significant disabilities to live and work in community settings.

This unprecedented funding may be a one-time opportunity for your school to invest in new, innovative resources. We believe, just as we always have, a good training video or educational resource is a wise investment. It can be used many times, by many people and you will be able to reap the benefits long after the funding is gone.
